La Segunda Sala de la Corte Suprema ha confirmado recientemente un fallo de la Octava Sala de la Corte de Apelaciones de Santiago, que rechaz\u00f3 un recurso de amparo presentado por un grupo de ciudadanos colombianos, con antecedentes penales previos, y a quienes se les aplic\u00f3 decreto de expulsi\u00f3n del pa\u00eds. Se trata de una decisi\u00f3n preocupante.<\/p>\n

La expulsi\u00f3n ejecutada implic\u00f3 la separaci\u00f3n familiar de 12 ni\u00f1as y ni\u00f1os, principalmente hijos de los recurrentes. A pesar de este hecho de especial relevancia jur\u00eddica, la Corte se limit\u00f3 a afirmar que la autoridad administrativa tiene amplias facultades legales para dictar los decretos de expulsi\u00f3n respectivos, no prestando atenci\u00f3n a dos cuestiones esenciales en este tipo de casos. En primer lugar, la Corte omite analizar si, en el caso espec\u00edfico bajo conocimiento, se restringen de una forma ‘estrictamente proporcional’ los derechos fundamentales del recurrente, as\u00ed como los de los ni\u00f1os y ni\u00f1as que puedan verse afectados por dicha decisi\u00f3n. La expulsi\u00f3n del pa\u00eds de un migrante constituye la medida administrativa m\u00e1s intensa que se puede adoptar en esa materia. Resulta de toda l\u00f3gica que, frente a ella, corresponda un control jurisdiccional particularmente estricto, a fin de evitar injusticias y vulneraciones graves a otros derechos en juego.<\/p>\n

En segundo lugar, el fallo da cuenta de un d\u00e9bil y err\u00f3neo conocimiento de lo dispuesto por la Convenci\u00f3n de Naciones Unidas sobre los Derechos del Ni\u00f1o en la materia. La Octava Sala de la Corte de Apelaciones cita el art\u00edculo 9.4 de la referida Convenci\u00f3n como antecedente para avalar la potestad de la autoridad administrativa para separar a ni\u00f1os de sus familias, reduciendo la obligaci\u00f3n del Estado a un mero ejercicio de notificar sobre el paradero del familiar o familiares del ni\u00f1o. Sorprende, por decir lo menos, que ambas cortes omitan mencionar lo que ese mismo art\u00edculo dispone en sus incisos 1 y 2.<\/p>\n

Esto es: a) Que pesa sobre el Estado la obligaci\u00f3n de velar porque los ni\u00f1os no sean separados de sus padres contra la voluntad de \u00e9stos, excepto cuando, a reserva de revisi\u00f3n judicial, las autoridades competentes determinen, de conformidad con la ley y los procedimientos aplicables, que tal separaci\u00f3n es ‘necesaria en consideraci\u00f3n a su inter\u00e9s superior’ y; b) Que en cualquier procedimiento entablado de conformidad a la letra anterior, se debe ofrecer a todas las partes interesadas la oportunidad de ‘participar en \u00e9l y de dar a conocer sus opiniones’<\/p>\n

(incluidos los propios ni\u00f1os afectados). Y son estas dos dimensiones las que la Corte simplemente pasa por alto, en directa infracci\u00f3n a lo dispuesto por la Convenci\u00f3n.<\/p>\n

Es de esperar que la Corte retome su amplia jurisprudencia previa en esta materia, velando porque la autoridad migratoria otorgue la debida protecci\u00f3n al inter\u00e9s superior de los derechos de los ni\u00f1os que habitan Chile.<\/p>\n
